Terms of Service

1. Service Publisher
The Podkstr service, available at podkstr.app, is published by Cyril Pereira, sole trader. The publisher's full identity, address, business registration number, publication director, and host are set out in the legal notice. Contact: contact@podkstr.com.
2. Purpose and Acceptance
These Terms of Service govern access to and use of the Podkstr platform, a SaaS podcast production service (recording, editing, hosting, distribution). By creating an account or using the service, you agree to these Terms and our Privacy Policy.
3. Service Description
Podkstr is a podcast production platform. The service includes:
- Live multi-participant recording
- Multi-track audio editor in the browser
- AI audio processing (transcription, echo removal)
- RSS hosting and distribution (Apple Podcasts, Spotify, etc.)
- Team collaboration with role management
- Available features depend on the subscribed plan (Free, Creator, Pro, Studio)
4. Registration and Accounts
Registration is open to any adult individual or legal entity. You agree to provide accurate information and to maintain the confidentiality of your credentials. You are responsible for all activity under your account. In case of unauthorized use, you must notify us immediately at contact@podkstr.com.
5. Subscriptions, Payment and Right of Withdrawal
The service offers free and paid plans. Paid subscriptions are billed monthly or annually via Stripe. Unless cancelled before the end of the current period, subscriptions renew automatically. You can cancel at any time from your settings; cancellation takes effect at the end of the current billing period. Right of withdrawal (EU consumers): pursuant to Articles L221-18 et seq. of the French Consumer Code (and equivalent EU consumer protection rules), you have 14 days from subscription to exercise your right of withdrawal. However, under Article L221-28 1° of the French Consumer Code, you expressly waive this right as soon as you request immediate execution of the service (creating episodes, audio rendering, AI processing, RSS publication, etc.) before the end of the 14-day period; in such case, no refund is owed for the period of actual use. 6. User Content
You retain all intellectual property rights over content you create and publish via Podkstr (audio recordings, metadata, images). You grant us a limited, non-exclusive license to host, store, distribute, and make your content accessible for the purpose of providing the service (RSS hosting, public feed, CDN). This license ends upon deletion of your content or account. You are solely responsible for the content you publish. It must not:
- Violate any applicable laws or regulations
- Infringe on third-party intellectual property rights
- Contain defamatory, hateful, threatening, or unlawful content
- Contain spam or unauthorized advertising
7. Hosting Status and Content Reporting
In accordance with French law n°2004-575 of June 21, 2004 (LCEN), the publisher acts as a hosting provider within the meaning of article 6-I-2. As such, the publisher is not subject to a general obligation to monitor content published by users. However, the publisher commits to promptly removing any manifestly unlawful content upon notification. To report unlawful content, send a notification to abuse@podkstr.com including:
- Your full name, address, and email
- Description of the disputed content and its location (RSS feed URL, episode title)
- Reasons why the content should be removed (legal reference if possible)
- A copy of correspondence sent to the content author, or justification for inability to contact them
8. Podkstr Intellectual Property
The Podkstr service, its source code, interface, features, brand, and logo are the exclusive property of the publisher. Any unauthorized reproduction, copy, or use is prohibited.
9. Service Availability
We strive to maintain the service available 24/7. However, the service is provided "as is" and "as available." We do not guarantee uninterrupted availability. Interruptions for maintenance, updates, or force majeure may occur. Availability targets are indicative and do not constitute a contractual commitment.
10. Limitation of Liability
To the fullest extent permitted by law, the publisher shall not be liable for any indirect damages, including data loss, revenue loss, business interruption, or any other damage resulting from use or inability to use the service. The publisher's total liability is limited to amounts paid by the user in the preceding 12 months.
11. Termination
You may delete your account at any time from your settings. The publisher reserves the right to suspend or delete an account in case of violation of these Terms, with email notification when possible. Upon deletion, your data will be erased in accordance with our Privacy Policy (30-day retention after deletion to allow recovery, then permanent erasure).
12. Changes to Terms
The publisher reserves the right to modify these Terms at any time. Users will be notified by email and via an in-app notification. Continued use of the service after modification constitutes acceptance of the new terms.
13. Governing Law
These Terms are governed by French law. In case of dispute, the parties will seek an amicable resolution. Failing that, the dispute will be submitted to the competent French courts. Under the French Consumer Code, you may also use a consumer mediator (list at https://www.economie.gouv.fr/mediation-conso).
